The Associated Press recently posted a story datelined Memphis that says a Gibson County man was convicted last week of poisoning red-tailed hawks and black vultures with a restricted use pesticide. The AP story says the man "tainted two deer carcasses and a goat carcass with the pesticide Aldicarb in January 2001 and put them in a field behind his home. Seven red-tailed hawks and two black vultures died from eating the poisoned meat. Both species are protected by the Migratory Bird Treaty Act. The maximum punishment for the insecticide offense is a year in prison and a $100,000 fine. Violation of the migratory birds act is punishable by up to six months in prison and up to a $15,000 fine." The AP story goes on to say that the man was sentenced to six months in prison and fined $500.00 in 1994 after he pleaded guilty to killing a Red-tailed hawk and a Great Horned Owl with bait poisoned by Aldicarb. He also pled guilty at that time to possession of the talons of a Great Horned Owl, "which investigators said were being prepared to be sold." The story says the man will be sentenced on the current charges in U.S. District Court in May. Let's hope justice is served and this guy gets all the time he deserves in jail, and the maximum fines. Sad as this case is, it allows us a chance to congratulate those agents and agencies involved in bringing about this prosecution.
