Danke

Beste Grüße

Thomas Loew

URGENT ACTION-FAILURE OF THE OGONI DIALOGUE PROCESS

MOSOP is warning of the failure of the Ogoni dialogue process because of
the imminent likelihood that approaches currently being used will cause a
crisis or even a widespread security clampdown in Ogoni.

The immediate issues are as follows:

* Ever increasing tendency to use the dialogue process as a fig leaf for
calls to resume Shell operations despite no meetings having actually taken
place involving all of the major protagonists -namely MOSOP, Shell and
government

* The ongoing abuse of an oil blowout in the Yorla field of Ogoni, which
has been burning since August 14th. Shell is still claiming 'access
problems' to the area despite funding the presence of armed youths at the
site since August.

* Government and Shell interests in the Ogoni oil block have intensified
to dangerous levels since the Department of Petroleum Resources announced
that Shell's license to operate in the Ogoni area would be revoked. We
understand Shell has subsequently been given 12 months to prove it can
operate in Ogoni and it has also been made clear that reserves in Ogoni
are very considerably more than has been acknowledged by Shell or
government

The contradictory nature of the current situation is such that an
announcement was made on Saturday 21st October of the imminent arrival of
a UNEP team to commence clean up preparations in Ogoni despite an
astounding silence on the longest running oil fire in Ogoni in decades.

We are concerned that the above issues will combine to cause a crisis in
the immediate future as the interests of grassroots membership who have
seen no reason for increased confidence in Shell come into conflict with
government interests and groups who have been actively financed or even
armed in anticipation of breaking resistance to Shell resuming operations.

Our concern in recent weeks has been to avoid opportunities for a crisis
to be precipitated especially in an environment where politicians and
other interests have shown increasing willingness to use armed gangs to
pursue their agendas. It is in this context we have asked our membership
to show restraint despite provocations

MOSOP will also be announcing this week its withdrawal from the Ogoni
dialogue until further notice in response to the failure of the
facilitator to convene meetings involving all of the key parties and the
unbalanced nature of meetings actually held

Action Requested: Please we are asking that as a matter of urgency you
write to Royal Dutch Shell to seek immediate action over the following:

* That Shell should provide an immediate and comprehensive explanation
over its failure to cap the oil fire at Yorla Well 13 and explain its
ongoing payments to youths securing the areas and what action is being
taken to end the oil fire

* That Shell officials seeking to retain the operating license for the
Ogoni area should be restrained from making any further illicit payments
whether to local youths, government officials, or local representatives

* That Shell should take all necessary steps to prevent its staff and
actions from contributing further to acrisis in the Ogoni area
specifically by ending association with armed groups and gangs

We also ask that you write to the United Nations Environment Programme
asking that:

* UNEP take due note of the recommendations of the UN Special Rapportuer
on Nigeria and the UN Fact Finding mission to Nigeria which made specific
recommendations on consultations and processes which could lead to an
environmental clean up in Ogoni

* UNEP take independent steps to ensure that all parties are being
consulted in regard to any action it takes regarding Ogoni

* UNEP immediately adds its voice to calls for urgent and more effective
action over the oil blowout at Yorla well 13 in Ogoni
