[wdmaudiodev] Strange behavior of "occupied" device

I have an application which lists devices as "occupied" if pin instantiation 
yields ERROR_BAD_COMMAND (22L).

If I play a stream with iTunes f.e. , this works fine. And above all fast.

But if I use a VM in Virtual Box which hogs the device, it takes AGES for pin 
instantiation to return.

What can cause this ? And is there another way to check whether a device is in 
use ?
